Recruiter Program Terms and Conditions

Important: These terms govern your participation in the voyeurlife Recruiter Program. By applying and participating, you agree to be bound by these terms in full.

Effective date: January 1, 2025

1. Introduction

These Recruiter Program Terms and Conditions ("Agreement") constitute a legally binding agreement between you ("Recruiter") and voyeurlife, operated at voyeurlife.com ("the Platform", "we", "us"). This Agreement governs your participation in the Platform's Recruiter Program, under which you may earn commissions by referring individuals who subsequently register as active performers ("Models") on the Platform.

These terms are supplemental to, and should be read in conjunction with, the Platform's general Terms of Service and Privacy Policy, which are incorporated herein by reference.

2. Eligibility

To participate in the Recruiter Program you must:

  • Be at least 18 years of age at the time of application.
  • Provide accurate personal and payment information during registration.
  • Successfully complete the identity verification and KYC (Know Your Customer) process.
  • Receive written approval from the Platform before your account is activated.
  • Not be a current employee, contractor, or director of the Platform or any of its affiliates.
  • Not be a resident of, or operating from, a jurisdiction where participation in such programs is prohibited by applicable law.

The Platform reserves the right to decline any application at its sole discretion, without being required to provide a reason.

3. Recruiter Obligations

3.1 Accurate Representation

You must represent the Platform and the Recruiter Program accurately and honestly at all times. You must not make guarantees of income, misrepresent earnings potential, or make any statement about the Platform that is false, misleading, or that the Platform has not authorised.

3.2 Compliance with Law

You are solely responsible for ensuring that all recruiting activities comply with applicable local, national, and international laws and regulations, including those relating to employment, advertising, data protection, and anti-spam legislation.

3.3 No Coercion or Exploitation

You must not use coercion, deception, undue pressure, or any exploitative practice when recruiting prospective Models. Any report or evidence of such conduct will result in immediate termination of your account and forfeiture of any unpaid commissions, and may be reported to the relevant authorities.

3.4 Referral Links

You may only use referral links and tracking codes issued to you by the Platform. You must not manipulate, disguise, or misrepresent referral links in any way. You must not use automated systems, bots, or click fraud to generate artificial referrals or traffic.

3.5 Prohibited Channels

You may not promote your referral link through:

  • Unsolicited bulk email (spam) or unsolicited direct messages.
  • Any platform or community in violation of that platform's terms of service.
  • Content targeting or accessible to minors.
  • Any illegal or fraudulent means.

4. Commission Structure

4.1 Eligibility for Commission

You are eligible to earn a commission when a prospective Model registers on the Platform using your unique referral link, is approved by the Platform, and generates qualifying earnings activity. Referrals who register without using your link, or who register after the referral tracking period has expired, do not qualify.

4.2 Commission Rate

Commission rates are set by the Platform and communicated to you upon approval of your application. Rates may be updated by the Platform from time to time with reasonable notice. Continued participation after notice of a rate change constitutes acceptance of the new rate. Commission is calculated as a percentage of qualifying net earnings generated by referred Models.

4.3 No Commission on Own Activity

You may not refer yourself or any person or entity under your control. Commission will not be paid on referrals that the Platform reasonably determines to be self-referrals or fraudulent.

4.4 Disputed Commissions

Any dispute regarding a commission must be raised in writing within 30 days of the relevant commission statement. The Platform's determination of qualifying activity is final.

5. Payment

5.1 Payment Schedule

Commissions are calculated monthly and paid within 30 days of the end of each calendar month, provided your account balance meets the minimum payout threshold in force at the time. The current minimum threshold is communicated in your recruiter dashboard and may be updated by the Platform.

5.2 Payment Methods

Payment is made via the method you specify in your account (bank transfer, PayPal, or cheque where available). You are responsible for ensuring your payment details are accurate and up to date. The Platform is not responsible for payments sent to incorrect details provided by you.

5.3 Taxes

You are solely responsible for the payment of all taxes, duties, and levies arising from commissions received under this Agreement. The Platform may be required by law to collect tax identification information and to report payments to relevant tax authorities. You agree to provide accurate tax information as requested.

5.4 Currency

All commissions are calculated and paid in United States Dollars (USD) unless otherwise agreed in writing.

6. Identity Verification and KYC

As a condition of activation, you must complete the Platform's identity verification process, which includes providing a government-issued photo ID and any other information reasonably requested by the Platform. Failure to complete verification will result in your account remaining inactive and no commissions being payable. The Platform may request updated or additional verification documents at any time to maintain compliance with applicable regulations.

7. Intellectual Property

The Platform grants you a limited, non-exclusive, revocable, non-transferable licence to use the Platform's name, logo, and approved marketing materials solely for the purpose of promoting the Recruiter Program through your referral link. You must not modify approved materials, create derivative works, or use the Platform's intellectual property in any way not expressly authorised. This licence terminates immediately upon the termination of this Agreement.

8. Confidentiality

You agree to keep confidential any non-public information about the Platform, its technology, commission rates (beyond what is publicly disclosed), and its business operations that you receive in connection with the Recruiter Program. This obligation survives termination of this Agreement.

9. Term and Termination

9.1 Duration

This Agreement commences upon approval of your application and continues until terminated by either party.

9.2 Termination by You

You may terminate your participation at any time by providing written notice to the Platform. Commissions earned and payable prior to the termination date will be paid in accordance with the normal payment schedule, subject to any deductions or offsets permitted under this Agreement.

9.3 Termination by the Platform

The Platform may terminate this Agreement immediately, without notice, if you:

  • Breach any provision of this Agreement or the Platform's general Terms of Service.
  • Engage in fraudulent, deceptive, or illegal activity.
  • Damage or attempt to damage the reputation of the Platform.
  • Fail to complete or maintain identity verification requirements.

The Platform may also terminate this Agreement for convenience upon 30 days' written notice. In the event of termination for convenience, commissions earned prior to the effective termination date remain payable.

9.4 Effect of Termination

Upon termination, your referral links will be deactivated and no further commissions will accrue. Any commissions forfeited due to breach will not be paid.

10. Limitation of Liability

To the maximum extent permitted by law, the Platform's total liability to you under this Agreement is limited to the commissions actually earned and unpaid at the time the claim arises. The Platform is not liable for any indirect, incidental, special, or consequential damages arising from your participation in the Recruiter Program, including loss of anticipated earnings.

11. Indemnification

You agree to indemnify and hold harmless the Platform, its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising from your breach of this Agreement, your recruiting activities, or your violation of any applicable law.

12. Modifications

The Platform reserves the right to modify these terms at any time. You will be notified of material changes by email or via your recruiter dashboard. Continued participation in the Recruiter Program following notice of a modification constitutes your acceptance of the revised terms. If you do not accept a modification, your remedy is to terminate your participation.

13. Relationship of Parties

You are an independent contractor. Nothing in this Agreement creates an employment, partnership, joint venture, agency, or franchise relationship between you and the Platform. You have no authority to enter into any agreement or incur any obligation on behalf of the Platform.

14. Governing Law

This Agreement is governed by and construed in accordance with the laws of the jurisdiction in which the Platform is registered. Any dispute arising from this Agreement that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the courts of that jurisdiction.

15. Entire Agreement

This Agreement, together with the Platform's general Terms of Service and Privacy Policy, constitutes the entire agreement between the parties with respect to the Recruiter Program and supersedes all prior discussions and representations. If any provision of this Agreement is found to be unenforceable, the remaining provisions continue in full force.
